Provacy Policy

YehBA* is a mobile social networking community that connects peoples in real time and allows users to communicating, share and making new friends using mobile phones or devices.

D3Systems recognizes the importance of your privacy and the protection of your personally identifiable information. This Privacy Policy is intended to inform you about the information D3Systems collects via YehBA*. The associated services offered with and enabled by YehBA* are referred to in this policy as the "YehBA* Services". Those who download and use YehBA* and/or any of the YehBA* Services are referred to in this policy as "users". This Privacy Policy also explains the practices applicable to the www.yehba.com website.

By activating your YehBA* account and registering your mobile phone number, you gain access to the YehBA* Services, which consists of the various services made available through YehBA* such as the YehBA* Instant Messaging service, sending messages through SMS and TXTPortal, mobile blogs and all related services, directories, listings, tools, information and databases. Your ongoing use of the YehBA* Services signifies your consent to the information practices disclosed in this Privacy Policy. If you object to any provision of this Privacy Policy, please do not proceed with registration and please do not use YehBA* and the YehBA* Services.

When you register with and/or use YehBA* and the YehBA* Services, you may provide D3Systems with, or D3Systems may otherwise obtain personally identifiable information (referred to as "Data" below). This Privacy Policy explains the information practices that apply to your Data. This Privacy Policy applies only to information D3Systems collects about you as a user of YehBA* and the YehBA* Services. This Privacy Policy does not apply to information about you collected by third party web sites and offerings linked to or otherwise accessible through YehBA* and the YehBA* Services. The information collected or obtained by these third parties is subject to their own privacy policies. Additionally, in the event that you access a service that is co-branded with a third party, such third party’s privacy policy, in addition to this Privacy Policy, may also apply.

Please keep in mind that while D3Systems encourages all third parties involved in providing the website and other associated services – including, but not limited to, our advertisers and distribution partners – to adhere to our policies regarding the privacy of YehBA* users and to otherwise handle personal information in a responsible manner, we cannot and do not assume any responsibility for any actions or omissions of third parties, including the manner in which they use information.

Any reference made in this Privacy Policy to D3Systems shall be deemed to have been made to D3Systems, Inc., its subsidiaries, successors-in-interest, assignees and affiliates.

Collection of Data

In order to use YehBA*, you must register or enroll for an account. As part of the registration process, we ask you to provide personal information such as your full name, birthday, gender, email address and your mobile number. We also require you to setup a User ID and password, which may be considered personal information. After the initial enrollment/registration, D3Systems will recognize your account through your mobile number whenever you login. YehBA* may collect additional information from users, including their IP address, browser, operating system and version. YehBA* may also collect the maker and model number of your mobile phone in order to optimize users’ experience with YehBA*. None of this additional information can be used to identify users personally.

If you use YehBA* and the YehBA* Services to disclose information about yourself publicly, for example, in or through chat rooms, groups, blogs or any other area reasonably understood to be a public area (collectively, the "Public Areas"), other users, which may or may not be YehBA* users, may obtain access to and use any such information you provide. You should therefore carefully consider whether you wish such information to be accessible by others. You should also note that others may be able to record certain information even if not made available in a Public Area, such as the content at a session (e.g., instant messages) or your IP address. The IP address is an integral part of the TCP/IP standard protocol of the internet and can be extracted by any party to the communication session using certain software and/or hardware.

D3Systems may also collect personal information from you when you visit the www.yehba.com website. For instance, when you send D3Systems an email asking a question, D3Systems may keep whatever information you provide for as long as it reasonably takes to answer your question. Like many websites, D3Systems may likewise automatically receive general information that is contained in the server log files such as your IP address.

Use of Data

D3Systems may use the Data to operate and improve the software, websites, services and offerings available through YehBA* and to communicate with you to respond to your inquiries.

The Data will not be shared to third parties unless:
  1. You have published the Data in Public Areas as defined above.
  2. D3Systems has obtained your prior consent to disclose the Data.
  3. D3Systems needs to disclose such information to fulfill a transaction you may have requested.
  4. D3Systems is required to disclose the Data pursuant to legal process (e.g., a court order, search warrant or subpoena) or law enforcement.
  5. D3Systems needs to send the Data to a third party working on behalf of D3Systems to provide you with YehBA* and/or the YehBA* Services. In such cases, D3Systems will only provide these third parties with the information they need to deliver the required service and they will only be permitted to use the Data in accordance with D3Systems’ instructions.
  6. You provide information to another party through YehBA* which is "Co-Branded" with a third party. Any Data you choose to provide through a "Co-Branded" service will be handled by either party in accordance with this Privacy Policy and the third party privacy policy. Please make sure to read both D3Systems’ and the third party’s privacy policies before providing information through a Co-Branded service.
  7. D3Systems finds that YehBA* and the YehBA* Services are being used in the commission of a crime or that your use of YehBA* and the YehBA* Services violates this Privacy Policy, the Terms of Service and/or the End User License Agreement.
  8. D3Systems has a good faith belief that there is an emergency that poses a threat to your safety or to the safety of another person.
  9. It is reasonably necessary to protect D3Systems’ legal rights and/or property and to enforce the provisions of the End User License Agreement, Terms of Use and this Privacy Policy.

D3Systems may use agents and contractors in order to help operate YehBA* and the YehBA* Services. If such agents and contractors have access to personally identifiable information, they are required to protect this information in a manner that is consistent with this Privacy Policy. In case ownership of YehBA* and the YehBA* services will change as a result of a merger, acquisition or transfer to another company, your Data may be used by the assignee or transferee in the same manner as D3Systems as set forth in this Privacy Policy.

Security Policy

D3Systems takes your right to privacy seriously. D3Systems follows generally accepted industry standards to protect the information that may be provided to D3Systems. Please note, however, that no method of transmission over the internet, or method of electronic storage, is 100% secure. Thus, while D3Systems strives to use commercially acceptable means to protect your information, D3Systems cannot guarantee its absolute security or that your personally identifiable information will never be disclosed in a manner inconsistent with this Privacy Policy.

You should be aware that communications over the internet are not secure unless they have been encrypted. D3Systems does not encrypt your communications. In addition, your communications may be routed through different countries, as that is the nature of the internet. D3Systems cannot accept any responsibility for any unauthorized access or loss of Data.

What you can do to protect your Personal Information

Some of the responsibility to prevent unauthorized access to your Data remains with you. You should be aware that receiving files from third parties via any application may be harmful. Please make sure not to receive files from users you do not know or trust, from users you are not sure they are whom they say they are or when you are not sure you would like to receive the files.

Use passwords to prevent unauthorized access to your account and mobile device. If you write down your password or User ID, keep the information in a secure location. Do not give your password to someone else unless you intend them to have full access to, and use of, your account. D3Systems likewise strongly encourages all users to check the operating instructions or similar documentation for their mobile phones prior to using YehBA* and the YehBA* Services.

Changes and Updates to this Privacy Policy

D3Systems may update this Privacy Policy from time to time and users are encouraged to review this Privacy Policy frequently.
